Man arrested for exposing himself near children playground, Plymouth New Zealand
A man has been jailed for exposing himself close to children in a playground in broad daylight.
Under the influence of drink and drugs, Brian Fagan was spotted by worried passers-by near to a busy Plymouth shopping precinct, a court heard.
Police arrested the 61-year-old from descriptions given by shoppers in Marlborough Street in Devonport.
Fagan, appearing before city magistrates in custody two days later, was jailed for 16 weeks.
Living at the nearby Salvation Army hostel, the defendant pleaded guilty to outraging public decency by exposing his penis close to the playground in adjoining Granby Way on July 29.
Court records state: "The offence is so serious because it was committed while on a community order and under the influence of drink and drugs, as well as the time and location of offence and presence of children."
Magistrates sentenced without a probation report, believing it would not help their decision.
Devin and Cornwall’s police said last week that they were called by several passers-by, including a parent with a young child, at about 4.30 pm last Thursday.
Ministry of Defence police who were driving past was flagged down by a worried shopper who had seen Fagan exposing himself.
Witnesses said that he was on a bench at the time.
